Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CoreControl ("Company," "we," "us," or "our") governing your access to and use of the CoreControl mobile application, website, and all related services (collectively, the "App").

By creating an account, downloading, installing, accessing, or using the App in any way, you unconditionally accept and agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time at our sole discretion. Material changes will be communicated by updating the "Last Updated" date at the top of this document. Your continued use of the App following any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old. If we discover that a user is under 18, we reserve the right to immediately terminate their account without notice or refund.

The App is intended for use in jurisdictions where it is lawful to do so. You are responsible for ensuring that your use of the App complies with all laws and regulations applicable in your jurisdiction.

To access certain features of the App, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activities that occur under your account
• Notify us immediately at support@corecontrol.live of any unauthorized use of your account

Each user is permitted one account. Creating multiple accounts to circumvent restrictions, access multiple free trials, or for any other purpose is prohibited and may result in termination of all associated accounts.

CoreControl is a male-focused pelvic floor fitness training application that provides:

• A structured 90-day progressive exercise program
• Morning and evening training sessions
• CoreScore performance tracking system
• Weekly challenge programs
• Educational content related to pelvic floor health
• Voice-guided coaching during sessions
• Progress tracking and achievement systems

We do not guarantee that the App will be available at all times. We reserve the right to modify, suspend, or discontinue the App or any feature thereof at any time without notice or liability.

We reserve the right to update, modify, or change any aspect of the App at any time, including features, content, pricing, and functionality.

THE APP AND ALL OF ITS CONTENT, INCLUDING BUT NOT LIMITED TO TRAINING PROGRAMS, EXERCISE INSTRUCTIONS, EDUCATIONAL MATERIALS, AND COACHING CUES, ARE PROVIDED FOR GENERAL FITNESS AND WELLNESS PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL ADVICE, MEDICAL DIAGNOSIS, MEDICAL TREATMENT, OR MEDICAL CARE OF ANY KIND.

YOU SHOULD CONSULT A QUALIFIED AND LICENSED HEALTHCARE PROFESSIONAL BEFORE BEGINNING ANY NEW EXERCISE PROGRAM, INCLUDING THE CORECONTROL PROGRAM, PARTICULARLY IF YOU:

• Have any pre-existing medical conditions
• Have had any recent surgeries or injuries
• Are currently under medical supervision
• Experience pain during or after exercise
• Have any concerns about your physical health

BY USING THE APP, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• Physical exercise involves inherent risks of injury
• You are voluntarily participating in these activities
• You assume full responsibility for any injury, illness, death, loss, or damage that may result from your participation
• CoreControl is not responsible for any physical or health-related outcomes

INDIVIDUAL RESULTS FROM USING CORECONTROL WILL VARY SIGNIFICANTLY. Any testimonials, success stories, or examples shown within the App represent individual experiences and are not intended to represent or guarantee that any other user will achieve the same or similar results. Your results will depend on numerous individual factors including but not limited to your starting condition, consistency of use, age, overall health, and individual physiology. CoreControl makes no representations or warranties regarding specific outcomes or results.

CoreControl offers the following subscription tiers:

New Pro subscribers are eligible for a 3-day free trial. The following conditions apply:

• Only one free trial per user, per device, per account
• The free trial begins on the date of subscription confirmation by Apple or Google
• After the 3-day trial period, your subscription will automatically convert to a paid subscription at the applicable rate
• If you do not wish to be charged, you must cancel your subscription at least 24 hours before the end of the trial period
• CoreControl reserves the right to modify or discontinue free trial offers at any time

YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD AT THE THEN-CURRENT SUBSCRIPTION PRICE UNLESS YOU CANCEL AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT PERIOD.

You authorize the applicable app store (Apple App Store or Google Play Store) to charge your payment method on file for each renewal period. Renewal charges will occur within 24 hours prior to the end of the current subscription period.

ALL PAYMENTS ARE PROCESSED EXCLUSIVELY THROUGH THE APPLE APP STORE OR GOOGLE PLAY STORE.

CoreControl does not directly collect, process, store, or have access to your payment information, including credit card numbers, bank account information, or billing addresses. All payment transactions are subject to the terms and conditions of Apple Inc. or Google LLC, as applicable.

You may cancel your subscription at any time:

Upon cancellation, your subscription remains active until the end of the current billing period. No prorated refunds are provided. Access to Pro features terminates at the end of the paid period.

ALL SUBSCRIPTION FEES ARE FINAL AND NON-REFUNDABLE EXCEPT WHERE REQUIRED BY APPLICABLE LAW.

Refund requests for Apple App Store purchases must be submitted to Apple at reportaproblem.apple.com. Refund requests for Google Play purchases must be submitted directly to Google. CoreControl has no control over refund decisions made by Apple or Google.

We reserve the right to change subscription pricing at any time. We will provide at least 30 days notice of any price increase to existing subscribers.

You are responsible for all applicable taxes, duties, and fees associated with your subscription. Apple and Google may collect applicable taxes on our behalf depending on your jurisdiction.

The App and all of its content, features, and functionality are the exclusive property of CoreControl and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, CoreControl grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the App solely for your personal, non-commercial fitness and wellness purposes.

You expressly agree that you will NOT:

• Copy, reproduce, distribute, or create derivative works based on any App content
• Reverse engineer, decompile, or disassemble any portion of the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use any content from the App for commercial purposes
• Sell, transfer, or sublicense your account or access to any third party
• Use automated systems or bots to access the App
• Scrape, crawl, or data mine any content from the App

If you provide any feedback, suggestions, or ideas regarding the App, you grant CoreControl a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate such feedback into the App without any obligation to you.

You agree to use the App only for lawful purposes and in accordance with these Terms.

You expressly agree NOT to:

• Violate any applicable federal, state, local, or international law or regulation
• Impersonate any person or entity or misrepresent your affiliation
• Engage in any conduct that restricts or inhibits any other user's use or enjoyment of the App
• Attempt to gain unauthorized access to any part of the App or its related systems
• Transmit any viruses, malware, or other harmful code
• Use the App to harass, abuse, or harm any person
• Collect or harvest any personally identifiable information from other users
• Use the App for any unauthorized commercial purpose

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

You may permanently delete your account at any time through the Profile section of the App. Upon deletion, all personal data associated with your account will be permanently and irreversibly deleted. Any active subscription must be cancelled separately through your device settings to avoid future charges.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CORECONTROL EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS OF CONTENT, UNINTERRUPTED OR ERROR-FREE OPERATION, AND FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS.

CORECONTROL DOES NOT WARRANT OR GUARANTEE THAT USE OF THE APP WILL RESULT IN ANY PARTICULAR FITNESS OUTCOME, HEALTH IMPROVEMENT, OR PERSONAL RESULT OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CORECONTROL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, PHYSICAL INJURY OR BODILY HARM, EMOTIONAL DISTRESS, OR COST OF SUBSTITUTE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CORECONTROL'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO CORECONTROL IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).

The limitations of liability in this section reflect a reasonable allocation of risk and are an essential element of the basis of the bargain between CoreControl and you.

Before filing any formal legal claim, you agree to first contact us at support@corecontrol.live and provide a written description of the dispute. We will attempt to resolve the dispute informally within 30 days of receiving your notice.

IF INFORMAL RESOLUTION FAILS, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES. THE ARBITRATOR'S DECISION SHALL BE FINAL AND BINDING.

YOU AND CORECONTROL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.

You may terminate your account at any time by deleting your account through the Profile section of the App. Termination does not entitle you to any refund of subscription fees.

We reserve the right to suspend or permanently terminate your account at our sole discretion, without notice, for any reason including violation of these Terms, fraudulent or illegal activity, conduct harmful to other users or CoreControl, or extended periods of inactivity.

Upon termination, your right to access and use the App immediately ceases, all licenses granted to you are immediately revoked, and we may delete your account data in accordance with our Privacy Policy.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoreControl regarding your use of the App and supersede all prior agreements and understandings.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

CoreControl shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, riots, government actions, or internet or telecommunications failures.

These Terms do not create any third party beneficiary rights.
